Hey, this is KnowledgeBorn GodAllah calling from Pelican Bay State Prison. A little back story, while I was on death row Robert Graff, out of Alameda County, was on my case and he did not give us any opportunity to present any forms of racial injustice, racial discrimination in my case, because he fought tooth and nail against everything.
Pamela Price [former Alameda Co. District Attorney] came in and removed him. Once she removed him, all the racial injustices came out in my court, which brought me back to Alameda County, for the Racial Injustice Act. While he was removed, Alameda County’s Dtrict Attorney’s office admitted to racial injustice, racial discrimination, and Theodore Landswick using the words,” I want y’all to kill this n**ga, this n**ga killed a n**ga, and I want y’all to come back with a verdict of death for this n**ga.” These were his words.
Now they took her off, as Pamela Price has left, and they put Robert Graff back on. Robert Graff asked for an extension of time first. And this extension of time ends July 1. However, he only gets one extension of time. He calls my attorney. My attorney’s name is Harry Simon. He calls my attorney and tells my attorney, “Hey, man, I’m not going to be able to respond to your order to show cause,” because now, we got a order to show cause and the judge has already admitted saying, “Hey, listen, this man has proved that there was a violation that took place. This man has proved that the violation cost him 37 years out of his life. This man has also proved, and made you say and admit, that you know that this violation took place. So give me a reason in order to show why I should not grant this man relief in my court.”
So, Robert Graff contacts my attorney, Harry Simon. He says, “Hey, I’m not going to be able to meet the deadline right now. So can you grant me — I’m going to ask the judge for an extension of time.” And my attorney says, “Okay, sure, go ahead.” My attorney did not consult me. My attorney did not even ask me. My attorney had nothing to say to me. I had already filed a [unclear] motion previously, telling him, “Do not make any decisions upon my life before I make a decision myself. This is my life.” And he did it again.
So, I’m letting the people know this is the reason why I’m not at home right now, is because my attorney is working with the enemy. This man knows my case. He’s on my case for 11 years while I was on death row. He fought tooth and nail against everything that we’re in Alameda County judicial courtroom for right now. So why give him an extension of time when he already knows the case? My attorney is Harry Simon, out of the Federal Defendant’s office down in Sacramento. I wrote Judge Chen, and I also need the people, lawyers, young lawyers, grassroot lawyers, to also contact Harry Simon as well as Judge Chen and let them know how we feel.
