Hey, what’s up everybody? This is Antoine Walker, aka Indy, calling out of Williamsburg, Pennsylvania, SCR Green. I’m calling in to do a follow up with y’all about the legal information I shared about the mandamus. A couple people were asking me what type of relief, if any, is available to people on there and also if you can get damages.
So specifically, I wanted to answer that question about damages first, for my research, and of course I request that y’all always double check. Another set of eyes is always welcome. But under Title 42 of Pennsylvania Statutes Section 2503A, one form of relief or damages you could get is for reimbursement of all the costs associated with the pursuit of the petition.
Even though that’s as I structured mine that’s under for petition of review. But I structured my mandamus as a petition for review of seeking of mandamus. Also Title 42 PA consolidated statute, section A303: a person who is a judge and an action in the nature of mandamus to have failed or refused without lawful justification to perform a duty required by law shall be liable in damages to the person aggrieved by such failure or refusal. Again, that’s title 42 of Pennsylvania’s Consolidated Statute, Section 8303. So yeah, not only can you get declaratory relief off of this, but you can also get damages for them denying you whatever rights you’re seeking to get enforced under mandamus. I just wanted to add that as a follow up to what I shared before.
